brev.fit involves strenuous physical activity. You are responsible for your own safety. Consult a qualified medical professional before starting any new exercise programme, especially if you have a pre-existing condition, are pregnant, or are recovering from injury. brev.fit is not a medical service and does not provide medical advice.
These Terms of Service ("Terms") govern your access to and use of brev.fit (the "Service"), operated from Australia by the team behind brev.fit ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 16 years old to use brev.fit. By using the Service you represent that you are at least 16, that the information you provide is accurate, and that your use of the Service complies with applicable laws in your jurisdiction.
2. Your account
You're responsible for keeping your login credentials secret and for all activity on your account. Tell us at support@brev.fit immediately if you suspect unauthorised use. You can delete your account at any time from the Settings screen.
3. Assumption of risk
Running and other endurance activities carry inherent risks including, but not limited to, musculoskeletal injury, cardiovascular events, traffic accidents, dehydration, and environmental hazards. You freely and voluntarily assume all such risks. The Service only records activities that you choose to perform — we don't set mandatory targets, and nothing in the app should be interpreted as instructing you to train beyond your capacity. You are solely responsible for deciding when, where, how, and whether to train.
4. Not medical advice
Content provided by brev.fit — including tier thresholds, training suggestions, performance summaries, and community discussion — is for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or fitness plan.
5. Acceptable use
You agree not to:
- Submit falsified or manipulated activity data — including but not limited to spoofing GPS, using bots, importing activities you didn't perform, or exploiting bugs to inflate metrics.
- Harass, threaten, or abuse other users, or post content that is unlawful, defamatory, or otherwise objectionable.
- Reverse-engineer, scrape, or attempt to gain unauthorised access to the Service or other users' data.
- Use the Service to compete with us or to build a similar product.
We may suspend or terminate accounts that violate these rules, adjust or remove falsified data, and — in serious cases — ban users permanently.
6. Third-party integrations
brev.fit integrates with Strava, Garmin, Apple Health, Google, and Apple Sign-in. Your use of those services is governed by their own terms. We're not responsible for their uptime, accuracy, or changes to their APIs, and if any of them limits or terminates access, some features may stop working.
7. Content and intellectual property
The Service, brand, and code are owned by us and our licensors. You retain ownership of the content you submit (crew names, display names, etc.), and you grant us a worldwide, royalty-free licence to host, store, and display that content solely to operate the Service.
8. Fees
brev.fit is free to use at launch. We may introduce paid plans in the future. If we do, we'll give you at least 14 days' notice and you'll be able to decline and continue using any free tier we keep available.
9. Termination
You can stop using brev.fit at any time. We can suspend or terminate your access if you break these Terms or if we reasonably believe your use poses a risk to us or other users. Sections that by their nature should survive (e.g. 3, 4, 10, 11) survive termination.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee that activity data from third-party integrations is complete or accurate.
11. Limitation of liability
To the maximum extent permitted by law, brev.fit, its contributors, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims arising from the Service will not exceed AUD $100 or the amount you paid us in the twelve months before the claim, whichever is greater. Nothing in these Terms limits liability that cannot lawfully be excluded, including under the Australian Consumer Law.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with the Service.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
